Investigations

Investigations usually take place when there has been an allegation of bullying, harassment, discrimination, grievances, capability, conduct including theft, whistle blowing or fraud. An effective investigation typically involves the following stages: preparation and scoping, delivery of the investigation and reporting back.

Our investigation service provides an impartial, structured and careful process with a clearly written report to the organisation with conclusions on whether or not there is a case to answer. Our workplace investigators use a variety of skills, strategies and techniques during the course of their investigation to ensure that the investigation is thorough, transparent, rigorous and effective.

HR Policy Development

Human resource policies are the formal rules and guidelines that businesses put in place to hire, train, assess, and reward employees. These policies, when implemented correctly in an easily used form, can serve to preempt many misunderstandings between employees and employers about their rights and obligations in the business place.

Our HR Policy Development scheme was created to support organisations in developing and embedding bespoke policies that reflect the nature and working of the organisation. The TCM Group will assist in clarifying the process involved in developing and reviewing Human Resources policies and to clearly outline the roles and responsibilities of those involved in the process.

Neutral Evaluations

A neutral evaluation is a proactive evaluation service where no specific allegations are made. The organisation wishes to have an independent examination or fact-find carried out.

Our Neutral evaluation service is ideal for use in complex workplace disputes such as multiple or counter grievances, collective disputes, team conflict or allegations of bullying, harassment or discrimination.

TCM will undertake a speedy and thorough evaluation of the current situation and provide a detailed report outlining the options available. We always ensure that we work within the time limits laid within your own policies and the Employment Act 2008.

Triage and Conflict Management

Organisations must have a strong assessment process for managing conflict and disputes. A triage or conflict management system involves a skilled individual determining the root cause of any conflict as well as who is involved and the desired outcome. This system helps organisations make an informed choice about the best resolution options.

A triage or conflict management system provides a legitimate opportunity for parties to describe a particular issue. TCM’s trained resolution consultants are able to ask appropriate and relevant questions. Options for resolving the issue, including the objective the person is seeking, as well as the likely outcomes, can be discussed. This collaborative approach results in people being better informed about their choices. It also provides people with a high level of responsibility for managing their own issues.

Appeals and Determinations

Our appeals and determinations service is aimed at helping organisations find a resolution for conflict, where the management find themselves in a challenging position of not being able to provide an impartial party to hear a grievance or disciplinary appeal. With the existence of the Employment Act 2008, it is important that each step of the process is conducted fairly, reasonably and with an open mind. To achieve a resolution, each step should ideally be undertaken by someone who has had no previous involvement in the matter. Failure to do so may result in an automatic unfair dismissal.

TCM provide an initial, and off site review of the paperwork relating to the grievance or disciplinary appeal, two hours of a qualified dispute resolution expert’s time to hear the grievance or appeal at your premises, one hour in order for the expert to deliberate once the hearing has been completed, one hour to deal with presenting and delivering the conclusion, and the appropriate letter confirming the decision as well as a final report to the employer.
